Why do I need a Will?
It's a question heard frequently
by Donohue Novak At Law. There are several reasons why a person should consider having a Will.
At Donohue
Novak At Law we believe one of the most important reasons is to properly provide for and protect your minor children
should a parent die unexpectedly. In your Will you name and appoint a Guardian and Trustee to care for your
minor children.
The Guardian is the individual who will take care of the day to day responsibilty
of raising your children. The Trustee is the individual who will supervise the financial assets available to care
for your minor children until they have completed their education. Both individuals (they can be the same person)
are selected by you prior to death and identified and appointed in your Will.
You control the designation
of those who shall be responsible for raising and caring for your children in a properly executed Will rather than leaving
it up to the discretion of the Probate Court.
Minnesota has strict requirements which set minimum standards for effective Wills.
If those standards are not met the Will may not be allowed by the Probate Court. A properly prepared and executed Will
does provide certainity that a person's wishes will be honored upon their death.
